\r\n\r\nyou agree that commercial advertisements, affiliate links, and other\r\n forms of solicitation may be removed from the Application without\r\n notice and may result in termination of the Services. Appropriate legal\r\n action will be taken by METRHACK for any illegal or unauthorised use of\r\n the Application; and
\r\n\r\nyou acknowledge and agree that any automated use of the Application or\r\n its Services is prohibited.
\r\n \r\nWhere the option is given to you, you may make payment of the\r\n Subscription Fee by way of:
\r\n\r\nElectronic funds transfer('EFT') into our nominated bank account
\r\n\r\nCredit Card Payment ('Credit Card')
\r\n\r\nAll payments made in the course of your use of the Services are made\r\n using Stripe. In using the Application, the Services or when making any\r\n payment in relation to your use of the Services, you warrant that you\r\n have read, understood and agree to be bound by the POLI terms and\r\n conditions which are available on their Application.
\r\n\r\nYou acknowledge and agree that where a request for the payment of the\r\n Subscription Fee is returned or denied, for whatever reason, by your\r\n financial institution or is unpaid by you for any other reason, then\r\n you are liable for any costs, including banking fees and charges,\r\n associated with the Subscription Fee.
\r\n\r\nYou agree and acknowledge that METRHACK can vary the Subscription Fee\r\n at any time and that the varied Subscription Fee will come into effect\r\n following the conclusion of the existing Subscription Period.
\r\n\r\nMETRHACK will only provide you with a refund of the Subscription Fee\r\n in the event they are unable to continue to provide the Services or if\r\n the manager of METRHACK makes a decision, at its absolute discretion,\r\n that it is reasonable to do so under the circumstances . Where this\r\n occurs, the refund will be in the proportional amount of the\r\n Subscription Fee that remains unused by the Member (the 'Refund').
\r\n \r\nThe Application, the Services and all of the related products of\r\n METRHACK are subject to copyright. The material on the Application is\r\n protected by copyright under the laws of Australia and through\r\n international treaties. Unless otherwise indicated, all rights\r\n (including copyright) in the Services and compilation of the\r\n Application (including but not limited to text, graphics, logos, button\r\n icons, video images, audio clips, Application, code, scripts, design\r\n elements and interactive features) or the Services are owned or\r\n controlled for these purposes, and are reserved by METRHACK or its\r\n contributors.
\r\n\r\nAll trademarks, service marks and trade names are owned, registered\r\n and/or licensed by METRHACK, who grants to you a worldwide,\r\n non-exclusive, royalty-free, revocable license whilst you are a Member\r\n to:

\r\n\r\nMETRHACK does not grant you any other rights whatsoever in relation\r\n to the Application or the Services. All other rights are expressly\r\n reserved by METRHACK.
\r\n\r\nMETRHACK retains all rights, title and interest in and to the\r\n Application and all related Services. Nothing you do on or in relation\r\n to the Application will transfer any:
\r\n\r\nbusiness name, trading name, domain name, trade mark, industrial\r\n design, patent, registered design or copyright, or
\r\n\r\na right to use or exploit a business name, trading name, domain\r\n name, trade mark or industrial design, or

\r\n\r\nthe accuracy, suitability or currency of any information on the\r\n Application, the Services, or any of its Services related products\r\n (including third party material and advertisements on the\r\n Application);
\r\n\r\ncosts incurred as a result of you using the Application, the Services\r\n or any of the products of METRHACK; and
\r\n\r\nthe Services or operation in respect to links which are provided for\r\n your convenience.
\r\n \r\nIf you are in the business of providing similar Services for the\r\n purpose of providing them to users for a commercial gain, whether\r\n business users or domestic users, then you are a competitor of\r\n METRHACK. Competitors are not permitted to use or access any\r\n information or content on our Application. If you breach this\r\n provision, METRHACK will hold you fully responsible for any loss that\r\n we may sustain and hold you accountable for all profits that you might\r\n make from such a breach.
\r\n\r\nMETRHACK's total liability arising out of or in connection with the\r\n Services or these Terms, however arising, including under contract,\r\n tort (including negligence), in equity, under statute or otherwise,\r\n will not exceed the resupply of the Services to you.
\r\n\r\nYou expressly understand and agree that METRHACK, its affiliates,\r\n employees, agents, contributors and licensors shall not be liable to\r\n you for any direct, indirect, incidental, special consequential or\r\n exemplary damages which may be incurred by you, however caused and\r\n under any theory of liability. This shall include, but is not limited\r\n to, any loss of profit (whether incurred directly or indirectly), any\r\n loss of goodwill or business reputation and any other intangible\r\n loss.
\r\n\r\nThe Terms will continue to apply until terminated by either you or by\r\n METRHACK as set out below.
\r\n\r\nIf you want to terminate the Terms, you may do so by:
\r\n\r\nnot renewing the Subscription prior to the end of the Subscription\r\n Period;
\r\n\r\nproviding METRHACK with 30 days' notice of your intention to\r\n terminate; and
\r\n\r\nclosing your accounts for all of the services which you use, where\r\n METRHACK has made this option available to you.
\r\n\r\nYour notice should be sent, in writing, to METRHACK via the 'Contact\r\n Us' link on our homepage.
\r\n\r\nMETRHACK may at any time, terminate the Terms with you if:
\r\n\r\nyou do not renew the Subscription at the end of the Subscription\r\n Period;
\r\n\r\nyou have breached any provision of the Terms or intend to breach any\r\n provision;
\r\n\r\nMETRHACK is required to do so by law;
\r\n\r\nthe provision of the Services to you by METRHACK is, in the opinion of\r\n METRHACK, no longer commercially viable.
\r\n\r\nSubject to local applicable laws, METRHACK reserves the right to\r\n discontinue or cancel your membership at any time and may suspend or\r\n deny, in its sole discretion, your access to all or any portion of the\r\n Application or the Services without notice if you breach any provision\r\n of the Terms or any applicable law or if your conduct impacts\r\n METRHACK's name or reputation or violates the rights of those of\r\n another party.
\r\n \r\nYou agree to indemnify METRHACK, its affiliates, employees, agents,\r\n contributors, third party content providers and licensors from and\r\n against:
\r\n\r\nall actions, suits, claims, demands, liabilities, costs, expenses,\r\n loss and damage (including legal fees on a full indemnity basis)\r\n incurred, suffered or arising out of or in connection with Your\r\n Content;
\r\n\r\nany direct or indirect consequences of you accessing, using or\r\n transacting on the Application or attempts to do so; and/or
\r\n\r\nany breach of the Terms.
\r\n\r\nIf any part of these Terms is found to be void or unenforceable by a\r\n Court of competent jurisdiction, that part shall be severed and the\r\n rest of the Terms shall remain in force.
